In using the Wedding List Giving Ltd websites, websites (www.lifelonggiving.com - www.weddinglistgiving.com - www.civilpartnershipgiving.com - www.anniversarygiving.com - www.christmasgiving.com - www.birthdaygiving.com - www.inmemorygiving.com) any of our services and any other site operated by Wedding List Giving Ltd, implies acceptance of these Terms & Conditions of service by the charity. Please read them carefully before proceeding further.

Changes to the service of to these Terms & Conditions of service

Wedding List Giving Ltd (‘WLG’) makes every effort to ensure that all websites and other services are available continuously, but reserves the right to modify, suspend or discontinue all or any part at any time with or without notice. Unless specifically exempted, any new services introduced shall be subject to these Terms & Conditions of service of Service.

WLG reserves the right to modify or replace these Terms & Conditions of service at any time, such changes shall be effective immediately it appears on the website. It remains the Charity's responsibility to access and check these Terms & Conditions of service whenever the Charity accesses the Website.

If you breach these Terms & Conditions of service, WLG reserves the right to terminate/deny (without notice) use of the website and associated services.

These terms were last updated on 10th October 2007 and replace all previous Terms of Service.

Responsibilities of the Service Provider

WLG will:

  • Maintain and develop the WLG websites whilst striving to cause minimum disruption to services. WLG reserves the right to suspend the service in the event of maintenance or key development, but will notify users (both clients and public) of any disruption, unless circumstances are unforeseen
  • Deal with telephone and email enquiries from registrants and donors in the most appropriate and timely fashion on behalf of the Charity
  • Enable couples and individuals to register online onto the schemes and will capture and securely store all key registration data
  • Acknowledge every registrant by email
  • Enable individuals to donate to the charities online via an online card processor via the registrant’s web page, and will pay all funds into the charities’ client account (this account, held with the Co-operative Bank, is a legal client account and monies in it are not the property of WLG but of the clients).
  • Collate payments and pass these to the relevant Charities on a monthly basis
  • Enable all donors who are UK taxpayers the option of making a Gift Aid declaration.
  • Acknowledge each donor for their donation by email
  • Claim Gift Aid on behalf of the Charity on a quarterly basis
  • Maintain a thorough Gift Aid audit trail in line with HMRC audit requirements
  • Ensure that Gift Aid monies are paid by HMRC into a second client account (held with HSBC) and transfer Gift Aid to the relevant charities within one week of the payment reaching the client account.
  • Ensure that administration fees of 12/28p (to become 12/23p) post April 2008 plus VAT (when appropriate) are deducted from funds raised prior to passing funds to the relevant charities.
  • Act in accordance with the Data Protection Act 1998 in relation to donor and registrant data.
  • Enable charities to securely access relevant donation data and reports relating to donors and to the processing of payments in line with the Data Protection Act 1998
  • Comply with the provisions of the Charities Act, 1992 and the Charitable Institutions (Fundraising) Regulations, 1994

Responsibilities of the client

The Charity will:

  • Return all information elements and paperwork required to complete the registration process to the charity within four weeks of receipt. Elements include: Contract, CHN2, Name & Logo agreement, Direct Debit mandate.
  • Provide appropriate and legally permitted content for display on the WLG websites respecting intellectual property rights of third parties
  • Carry information about the Lifelong Giving schemes on their website, including a link to the site(s) and will promote the schemes through their own communication channels wherever possible
  • Pay an annual fee of £100 or a monthly subscription fee of £7.50 plus VAT (where appropriate) via direct debit, entitling the Charity to participate in the scheme for one calendar year or one month respectively
  • Permit WLG to deduct a 12/28p (to become 12/23p from April 2008) plus VAT (when appropriate) administration fee for every 28p of Gift Aid reclaimed on its behalf

Trademarks

The names Lifelong Giving, lifelonggiving.com, Wedding List Giving, WLG, weddinglistgiving.com, Birthday Giving, birthdaygiving.com, Christmas Giving, christmasgiving.com, Civil Partnership Giving, civilpartnershipgiving.com, Anniversary Giving, anniversarygiving.com, the anniversary giving logo, the wedding list giving logo, the civil partnership giving logo, the Christmas giving logo, the birthday giving logo, the lifelong giving logo and any other product and service names that we may present on the site from time to time may not be used in connection with any product or service that is not that of WLG, nor in any manner that is likely to cause confusion, or in any way that may disparage or discredit WLG.

Other trademarks, service marks or logos that appear on the site, in particular (but not exclusively) those of member charities, are the property of their respective owners and are likely to be registered trademarks and subject to restrictions as to their use. They must not be used without the express permission of the trademark owner.

All content, including images and artwork, on the WLG websites is owned by WLG, participating charities, or other original providers and is protected by the applicable intellectual property and proprietary rights and laws. Use of the websites content is not permitted without the express prior permission of WLG and, where applicable, the copyright holder.

Special conditions

  • The Charity has the right to audit WLG on request, giving notice of 30 days.
  • WLG. will not sell the details of donors, specific to the Charity, to any other organisation.
  • The Charity will have the right to sign off of promotional materials bearing their name or logo prior to publication.
  • Both parties have the right to terminate the contract with a notice period of 30 days. However, notice of cancellation must be given by the 5th of the calendar month preceeding the required exit month. If notice is received after this date, an invoice will be issued for a further month.
  • WLG reserves the right to withdraw the Website from public access at any time, at its complete discretion.
  • Where the Charity does not return the Gift Aid reclaim form (R68) within a period of one month post receipt, WLG is hereby authorised to deduct the administration fees plus VAT (where appropriate) from the donations raised.

A person who is not a party to these Terms & Conditions of service has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms & Conditions of service.

These Terms & Conditions of service are governed by the laws of England and Wales.
